Terms of Service

1. Who we are and acceptance

ExperienceRelay is tour booking software for tour operators: availability, reservations, channel listings and calendar sync in one dashboard. These terms are the agreement between you and us for the dashboard at experiencerelay.com and the booking sites it powers, such as osakacastletours.com. By signing in, using the dashboard or taking bookings through a site we operate, you agree to these terms and to our Privacy Policy. If you book a tour as a guest, these terms also apply to that booking.

2. The service

We provide software for managing tours: availability and pricing, reservations, listings on connected channels (for example GetYourGuide or Viator), and optional Google Calendar sync. The software is the product; the tours themselves are offered and run by the operators who use it.

3. Accounts

• You sign in with your Google account and are responsible for the activity under it.
• You must give accurate information and keep your access to your Google account secure.
• One operator, one account — don't share your account or let others use it for you.
• You must be at least 18 years old to use the dashboard.

4. Your obligations as an operator

• The tours, descriptions, prices and availability you publish must be accurate and lawful, and you must have the rights needed to offer them.
• You are responsible for running the tours you sell and for fulfilling bookings customers make through your site or connected channels.
• Don't misuse the service — no unlawful content, no interference with the service or other users, no attempts to access data that isn't yours.

5. Bookings, payments and channels

• Guest bookings are confirmed in the dashboard; payment for bookings is processed by PayPal under PayPal's own terms.
• When you connect a channel such as GetYourGuide, that channel's own terms apply to the listings and bookings flowing through it, and its supplier agreement governs your relationship with it.
• Cancellations, refunds and changes follow the policy you set for each tour, together with any mandatory consumer rights.

6. Google Calendar connection

If you choose to connect Google Calendar, we use the calendar scopes described in the Privacy Policy to read and write events on your own calendar so busy tour times block correctly. You can disconnect at any time in Settings, which deletes the Google tokens we hold. Google's own terms apply to your use of Google Calendar.

7. Service availability

The service is provided "as is" and "as available". We work to keep it reliable but don't promise uninterrupted or error-free operation, and we may modify, suspend or withdraw parts of the service — for maintenance, fixes or improvements — with as much notice as is reasonable in the circumstances.

8. Your content and our intellectual property

• You keep ownership of the tours, content and data you enter. You give us the licence needed to host, display and operate it for you — including syncing it to channels you've connected.
• The software, branding (including the ExperienceRelay name and logo) and the site designs belong to us. These terms don't transfer any of that to you.

9. Disclaimers and liability

• To the extent permitted by law, we disclaim warranties not stated in these terms, including implied warranties of merchantability and fitness for a particular purpose.
• To the extent permitted by law, we aren't liable for indirect, incidental or consequential losses, or for lost profits, arising from your use of the service.
• Our total liability for any claim arising out of the service is limited to the fees you paid us in the 12 months before the claim (or JPY 100,000 if you haven't paid fees).
• Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or wilful misconduct.

10. Termination

You can stop using the service at any time and ask us to delete your account data as described in the Privacy Policy. We may suspend or terminate your access if you breach these terms, if required by law, or to protect the service and its users. Sections that by their nature should survive termination (including disclaimers and liability limits) survive it.

11. Changes to these terms

We may update these terms; the "Last updated" date above changes when we do. Material changes will be announced in the dashboard or by email. Continuing to use the service after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Japan, and the courts of Osaka have exclusive jurisdiction over any dispute arising out of them — without prejudice to mandatory consumer protections that apply to you.
